We appreciate that you are trusting us with your personal information. We take your privacy very seriously. In this Privacy Policy, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy that you do not agree with, please discontinue use of our services immediately

This Privacy Policy applies to all information collected through our Academy services (which, as described above, includes our website, https://joningham.academy/, as well as any related services, sales, marketing or events.

1. WHAT INFORMATION DO WE COLLECT?

We collect information that you provide to us. We collect personal information that you voluntarily provide to us when you register on the Jon Ingham Strategic HR Academy website, https://joningham.academy/, express an interest in obtaining information about us or our products and Academy services, when you participate in activities on the website (such as by posting messages in our online forums or entering competitions, contests or giveaways). The personal information that we collect depends on the context of your interactions with us and the  website, the choices you make and the products and features you use. The personal information we collect may include the following:

Personal Information Provided by You. We collect names, email addresses, usernames, passwords, job titles, contact preferences, contact or authentication data, billing addresses, debit/credit card numbers, mailing addresses, phone numbers,

Payment Data. We may collect data necessary to process your payment if you make purchases,(such as a credit card number), and the security code associated with it. All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information. Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Academy website https://joningham.academy/. We automatically collect certain information when you visit, use or navigate the website. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about who and when you use our website and other technical information. This information is primarily needed to maintain the security and operation of our website, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies. The information we collect includes: log and usage data. Log and usage data is service-related, diagnostic usage and performance information our servers automatically collect when you access or use our website and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type and settings and information about your activity in the website (such as the date/time stamps associated with your usage, pages and files viewed, searches and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called ‘crash dumps’) and hardware settings).

Location Data. We collect information data such as information about your device’s location, which can be either precise or imprecise. How much information we collect depends on the type of settings of the device you use to access the Academy website. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your location settings on your device. Note however, if you choose to opt out, you may not be able to use certain aspects of the Academy services.

Your Gravatar. An anonymised string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media. If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the Academy website, https://joningham.academy/, can download and extract any location data from images on the website.

Embedded content from other websites. Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

2. HOW DO WE USE YOUR INFORMATION?

We process your information for purposes based on legitimate business interests, the fulfilment of our contract with you, compliance with our legal obligations, and/or your consent. We use personal information collected via our Academy website for a variety of business purposes described below. We process your personal information for these purposes in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations.

To facilitate account creation and logon process. If you choose to link your account with us to a third-party account (such as your Google or Facebook account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process for the performance of the contract.

To post testimonials. We post testimonials on our Academy website https://joningham.academy/that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and the consent of the testimonial. If you wish to update, or delete your testimonial, please contact us at [email protected] and be sure to include your name, testimonial location, and contact information. We may use your information to request feedback and to contact you about your use of our website.

To enable user-to-user communications. We may use your information in order to enable user-to-user communications with each user’s consent. We may use your information for the purposes of managing our account and keeping it in working order.

To fulfil and manage your orders.We may use your information to fulfil and manage your orders, payments, returns, and exchanges made through the Academy website https://joningham.academy/ and to support your experience throughout the academy website.

For prize draws and competitions. We may use your information to administer prize draws and competitions when you elect to participate in our competitions.

To deliver and facilitate delivery of services to the user. We may use your information to provide you with the requested service.

To respond to user inquiries/offer support to users. We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our Academy services.

To send you marketing and promotional communications. We and/or our third-party marketing partners may use the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. For example, when expressing an interest in obtaining information about us or our website, subscribing to marketing or otherwise contacting us, we will collect personal information from you. You can opt-out of our marketing emails at any time.

To deliver targeted advertising to you. We may use your information to develop and display personalised content and advertising (and work with third parties who do so) tailored to your interests and/or location and to measure its effectiveness.

3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfil business obligations. We may process or share your data that we hold based on the following legal basis: we may process your data if you have given us specific consent to use your personal information for a specific purpose. We may process your data when it is reasonably necessary to achieve our legitimate business interests.

Performance of a contract. Where we have entered into a contract with you, we may process your personal information to fulfil the terms of our contract.

Legal obligations. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).

Vital interests. We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

More specifically, we may need to process your data or share your personal information in the following situations:

Business transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

When you share personal information (for example, by posting comments, contributions or other content to the Academy website or otherwise interact with public areas of the website, such personal information may be viewed by all users and may be publicly made available outside the website. Similarly, other users will be able to view descriptions of your activity, communicate with you within our website

We may use cookies and other tracking technologies to collect and store your information. We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information.

5. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements).

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognise and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users who register on our website, we store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). website administrators can also see and edit that information.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

6. HOW DO WE KEEP YOUR INFORMATION SAFE?

We aim to protect your personal information through a system of organisational and technical security measures. We have implemented appropriate technical and organisational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorised third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our website is at your own risk. You should only access the Academy website https://joningham.academy/ within a secure environment.

7. DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly solicit data from or market to children under 18 years of age. By using the website, you represent that you are at least 18. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 8. WHAT ARE YOUR PRIVACY RIGHTS?

In some regions, such as the UK, European Economic Area, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time. In some regions (like the UK/European Economic Area), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent. Account Information. If you have an account on our website, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes. Visitor comments may be checked through an automated spam detection service.

If you would at any time like to review or change the information in your account or terminate your account, you can log in to your account settings and update your user account. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with applicable legal requirements.

Cookies and similar technologies. Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Academy website. Opting out of email marketing. You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list – however, we may still communicate with you, for example to send you service-related emails that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes. 9. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognising and implementing DNT signals has been finalised. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

10. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information. California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided at the end of the Privacy Policy. To request removal of data, please contact [email protected] and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the website, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g. backups, etc.).

CCPA Privacy Notice. The California Code of Regulations defines a “resident” as: (1) every individual who is in the State of California for other than a temporary or transitory purpose and 2) every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose. All other individuals are defined as “non-residents.” If this definition of “resident” applies to you, certain rights and obligations apply regarding your personal information.

What categories of personal information do we collect? We have collected the following categories of personal information in the past twelve (12) months:

Contact details, such as real name, alias, postal address, telephone or mobile contact number, unique personal identifier, online identifier, Internet Protocol address, email address and account name.

Commercial information, such as transaction information, purchase history, financial details and payment information

Education Information, for example student records or directory information

We may also collect other personal information outside of these categories in instances where you interact with us in-person, online, or by phone or mail in the context of: receiving help through our customer support channels.

How do we use and share your personal information? More information about our data collection and sharing practices can be found in this Privacy Policy. You may contact us by email at [email protected].

If you are using an authorised agent to exercise your right to opt-out, we may deny a request if the authorised agent does not submit proof that they have been validly authorised to act on your behalf. We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Each service provider is a for-profit entity that processes the information on our behalf. We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be “selling” of your personal data. Strategic Dynamics Consultancy Services Ltd has not disclosed or sold any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. Strategic Dynamics Consultancy Services Ltd will not sell personal information in the future belonging to website visitors, users and other consumers.

Your rights with respect to your personal data.

Right to request deletion of the data. You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation or any processing that may be required to protect against illegal activities. Depending on the circumstances, you have a right to know: whether we collect and use your personal information; the categories of personal information that we collect; the purposes for which the collected personal information is used; whether we sell your personal information to third parties; the categories of personal information that we sold or disclosed for a business purpose; the categories of third parties to whom the personal information was sold or disclosed for a business purpose; and the business or commercial purpose for collecting or selling personal information. In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.

Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights. We will not discriminate against you if you exercise your privacy rights.

Verification process. Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with the information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate. We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Other privacy rights. You may object to the processing of your personal data, you may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the data, you can designate an authorised agent to make a request under the CCPA on your behalf. We may deny a request from an authorised agent that does not submit proof that they have been validly authorised to act on your behalf in accordance with the CCPA. You may request to opt-out from future selling of your personal information to third parties. Upon receiving a request to opt-out, we will act upon the request as soon as feasibly possible, but no later than 15 days from the date of the request submission. 11. DO WE MAKE UPDATES TO THIS NOTICE?

Yes, we will update this notice as necessary to stay compliant with relevant laws. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this Privacy Policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this Privacy Policy frequently to be informed of how we are protecting your information.

12.  HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?

Based on the applicable laws of your country, you may have the right to request access to the personal information we collect from you, change that information, or delete it in some circumstances.

Welcome to the Jon Ingham Strategic HR Academy, trading name of Strategic Dynamics Consultancy Services Ltd. This document explains the terms by which you may access or use our services, website, applications, technology, software and any other components (collectively referred to as the “service” or “academy”). Our terms of use applies to all users including visitors, members, customers and others who access or use the service. By accessing or using the service, you agree to be bound by this policy. These terms and conditions are separate to our Privacy Policy. Please make sure you review the terms and conditions relating to the posting and use of user content.

1. Our Service

The Jon Ingham Strategic HR Academy provides a web-based learning environment for HR practitioners.

Standard platinum, gold and silver memberships and individual courses are offered to individual, internal (permanent or interim) HR practitioners.

Annual Membership. Platinum and gold memberships are offered on an annual basis. At the end of the year, if not extended by the member, membership will be reduced to silver membership.

Individual courses. These can also be purchased on an annual basis.

Silver membership. This is offered on an ongoing basis and will continue as long as a member remains an in-house HR practitioner.

Group membership. The academy offers tiered pricing for 2, 3, 4, 5-9, 10-19, and 20-49 course attendees or gold members from the same company if this organisation wishes to provide access to more than one individual. If an organisation would like to provide gold membership access to more than 50 individuals they should contact Jon Ingham about setting up a stand-alone, enterprise version of academy.

Study groups. the need for academy members to contribute to the academy applies particularly strongly to participation in study groups. Everyone in these groups is expected to: contribute to an initial welcome and objective setting call, or if this is not possible, to make time available to discuss their own needs in a separate call, which will then be shared with other study group participants.

Partner Membership. Consultants, vendors and other suppliers to HR can take out academy partner membership. Platinum, gold and silver members becoming suppliers will be offered initial discounts to move to partner membership.

The social hub. This is where members can share any general content or start general discussions.

All online services detailed on this site will remain operational until Jon dies, retires or sells the academy or something. (But he is currently planning to run this for the next ten years and beyond.)

Upon early closure, annual gold / platinum / partner memberships and annual but not extended course payments will be refunded in proportion to the timing involved

2. Sharing of Content

2.1 If you become a member you and anyone in your member group may share your information with the academy, which will then be displayed and accessible to other members. Therefore, do not upload, publish, display, share, submit, link to, post or otherwise make available information to the service which you do not want to be public. It is entirely your responsibility to advise and manage your member group re the posting of information.

2.2 You agree to defend and indemnify Jon Ingham Strategic HR Academy from any and all liabilities, losses, costs, damages, issues, penalties and fines including legal fees in connection with you or your member group’s use or posting of any user content.

3. Eligibility

You may use the service only if you form a binding contract with Jon Ingham Strategic HR Academy, and only in compliance with all applicable local, national, and international laws, rules, and regulations. You must be 18 years old or older to use or access the academy. Any use or access to the academy by anyone under 18 is strictly prohibited and in violation of our agreement. Jon Ingham Strategic HR Academy may not be available to any users previously removed from the academy.

4. Changes and Discontinued Service.

The academy and any features and functionality provided online may change, be canceled or modified at any time, in our sole discretion.

5. Member Accounts and Member Groups

In order to use or access the Jon Ingham Strategic HR Academy, you will need to register and create an account (“Member Account”). A member account gives you access to any service purchased by you or your member group. We may maintain different types of accounts for different types of members. If you open a member account on behalf of yourself, you will be responsible for your use and access to the academy. If you open a member account on behalf of a company, organisation or entity, then “you” includes you and that entity and the users associated with it  (collectively, the “Member Group” and each being a “Member”), and you represent and warrant that you are an authorised representative of the entity. By connecting to Jon Ingham Strategic HR Academy via a third-party service, you give us permission to access and use your information from that service as permitted by that service, and to store your log-in credentials for that service.

6. Member Account Registration, Passwords and Profiles

You may never use another member’s account without permission. When creating your member account, you must provide accurate and complete information, and update it from time to time as needed. You are solely responsible for the activity that occurs on and with your member account. You must keep all passwords secure, and you must notify the academy immediately of any breach of security or unauthorised use of your member account or any passwords. Please be aware, although Jon Ingham Strategic HR Academy will not be liable for your losses caused by any unauthorised use of your member account, you shall be liable for the losses of Jon Ingham Strategic HR Academy or others due to such unauthorised use.

7. Communications From the Academy

You may use the Settings in the academy website to control your member profile. By providing Jon Ingham Strategic HR Academy your email address and other contact information, you consent to our using the email address and the contact information to send you academy-related notices, including any notices required by law, in place of communication by postal mail. We may also use your email address and other contact information provided to send you other messages, including changes to features of the academy and special offers. If you do not want to receive such email messages, you may opt out by changing the preferences in your Notifications Settings. Opting out may prevent you from receiving email messages regarding updates, improvements, or offers.

8. Rules for Using the Service

8.1 Prohibited Activities

You can use the Jon Ingham Strategic HR Academy as long as you don’t:

  • copy, distribute, or disclose any part of the academy in any medium;
  • alter or modify any part of the academy, other than as may be reasonably necessary to use the academy for its intended purpose;
  • use or launch any automated system, including without limitation, “robots,” “spiders,” “offline readers,” etc., that accesses the academy in a manner that sends more request messages to the academy servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser;
  • collect or harvest any personally identifiable information, including account names, from the academy nor to use the communication systems provided by the academy for any commercial solicitation purposes;
  • use any portion of the academy as a destination linked from any unsolicited bulk messages or unsolicited commercial messages;
  • attempt to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the academy;
  • take any action that imposes, or may impose, at our sole discretion an unreasonable or disproportionately large load on our infrastructure;
  • upload invalid data, viruses, worms, or other software agents through the academy;
  • impersonate another person or otherwise misrepresent your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity;
  • interfere with the proper working of the academy;
  • bypass the measures we may use to prevent or restrict access to the academy, including, but not limited to, registering for the academy with a non-edition email address

9. Right to Suspend or Terminate Use

Jon Ingham Strategic HR Academy may permanently or temporarily terminate, suspend, or otherwise refuse to permit you access or use of the academy, without notice or liability, at any time, particularly if, in Jon Ingham’s Strategic HR Academy’s sole determination, you violate, or appear to be violating, any of the agreements, including the prohibited activities outlined above.

10. Online Purchases

Your use of online purchasing includes the ability to make transactions electronically via the Jon Ingham Strategic HR Academy website located at http://joningham.academy. Any service you use or purchase, whether via the academy online purchasing or otherwise, may include additional terms and payment. If you are not comfortable with the additional terms, payment obligations, do not use or purchase the service.

11. Delivery and Access

When you purchase a right to use or access a service, the service will be available for digital delivery shortly after payment has been received and processed, or if applicable, after an advertised start date.

12. Payment

Jon Ingham Strategic HR Academy uses a third-party service provider to manage credit card processing, and your credit card information is transmitted directly to the third-party service. This third-party processing service is not permitted to store, retain, or use your billing information except as necessary to process your credit card information for current or future purchases through

Your full credit card number is never transmitted to or viewed by anyone at Jon Ingham Strategic HR Academy (however, we are given and may print a portion of your credit card information on your receipt to let you know what credit card you used to make a purchase). The company name on your receipt will appear as Jon Ingham Strategic HR Academy, part of Strategic Dynamics Consultancy Services Ltd. You will receive an email receipt following each credit card charge.If at any time you fail to pay a fee charge when due, then in addition to all other remedies available to Jon Ingham Strategic HR Academy, the academy may immediately suspend or terminate the service, in whole or in part.

13. Platforms

By purchasing a service, you acknowledge and agree that the service may only be accessed through the Jon Ingham Strategic HR Academy digital learning environment and any other platforms, applications or sites that Jon Ingham Strategic HR Academy specifically authorises.

14. Fees For a Service That Was Free

If the academy provides or offers a service without charge, Jon Ingham Strategic HR Academy has the right at any time to starting charging a fee for the service, provided the academy notifies you of such fee before you incur it. If a fee applies, your use and access to the services is subject to your full and timely payment of such fee.

15. Availability and Refunds

Please be aware that all sales transacted through https://joningham.academy/ are final and non-refundable. However, if you are unable to access a service within a reasonable time after payment is made and you notify us of such within ten (10) days and the problems are caused by Jon Ingham Strategic HR Academy’s systems or technology, we will make commercially reasonable efforts to help troubleshoot the problem. If we are not able to remedy the problem within a reasonable time, at our sole discretion, we may provide you with a refund – please contact us at [email protected] as soon as you reasonably are able. Please be aware that the academy is under no obligation to troubleshoot the problem or provide a refund.

16 Cancellation

If you decide to cancel your membership account and you do so before your first service program is initiated, you will receive a full refund. If you choose to cancel after you have initiated the first service program, you will not receive any refund.

17. Group Member Transfers

For any group member purchases where multiple members rights are purchased to use the academy service, the member group may transfer the right from one member to another member upon notice to Jon Ingham Strategic HR Academy. In all cases however, it is imperative to securely and effectively manage passwords and access to the group member service between members (especially for any new members or members leaving the group) to ensure the member gccount is secure. Management of such is solely the group member’s responsibility and the group member will be held liable for any unauthorised access to the academy.

18. License to Use the Academy

Subject to payment of all applicable fees (including any applicable taxes) for access to or use of a Jon Ingham Strategic HR Academy service and subject to agreement to and compliance with the terms of the agreement, you are granted a non-exclusive, non-transferable, limited, fully revocable license to use or access the service. We reserve the right to refuse the service to any person or to cancel any order at our sole discretion. Also, Jon Ingham Strategic HR Academy reserves the right to change, without prior notice, service options and features and pricing.

19. User Content

User Content Is Not Private and Posting any Using User Content is Solely At Your Own Risk

The academy is designed to be interactive and will allow members to post information, including comments, experiences, questions, data, and feedback information (“user content”) to the academy. Accordingly, user content will be accessible to other members, who may further reference or post your user content elsewhere, whether or not they are part of your member group. Therefore do not post any information which you or your member group are not comfortable being viewed by the public.

20. Advise Your Members

We strongly advise you to clearly and actively advise your member group on an ongoing basis, and any new members, on the management of posting user content. As mentioned, management of the posting of user content by any member is solely your responsibility.

21. Your Responsibility For User Content

Jon Ingham Strategic HR Academy cannot and does not manage or actively review user content. You are fully liable and responsible for all matters relating to any user content, including the accuracy of such, right to post, and impact it may have on other members

22. Jon Ingham Strategic HR Academy and Other Member’s License to Use Your User Content

As the academy is interactive, it is entirely possible, and you should be prepared, that other members of Jon Ingham Strategic HR Academy may reference or use your user content via the academy or elsewhere. This may occur even after you terminate your member status or leave the member group. As part of using and accessing the academy, you hereby grant Jon Ingham Strategic HR Academy and all other members a right to post any and all user content for their own purposes. Jon Ingham Strategic HR Academy is not responsible for any posting of your user content.

23. Using Other Member’s User Content And Interacting With Other Members

You understand and acknowledge that you may be exposed to user content from others that is inaccurate, offensive, inappropriate, indecent, or objectionable. Jon Ingham Strategic HR Academy cannot and will not attest to the accuracy, veracity or legal status of any other member’s user content and your use of, reference to, or any posting of user content is solely at your own risk. Jon Ingham Strategic HR Academy is not and shall not be liable for any damages or losses arising from or in connection with your use or posting of any other member’s user content. You are solely responsible for your interactions with other academy users and members. We reserve the right, but have no obligation, to monitor disputes between you and other members.

24. Rights to Withdraw User Content/Not Protected

You may post user content in accordance with the agreement to the service and you may withdraw your user content at any time. Be aware though, other members, the member group you are a part of if applicable, and Jon Ingham Strategic HR Academy may have already posted your user content elsewhere as described above. You understand that posting your user content in the academy is not a substitute for registering it with any formal Copyright Office or any other rights organisation.

25. Solicitations Not Permitted

You are strictly prohibited from using any user content or any content or materials provided via the academy for marketing, advertising or solicitations at any time. If Jon Ingham Strategic HR Academy becomes aware or suspects any such use or reference with regard to any user content or any information or content or features provided via the academy, it has the right to immediately terminate or suspend your access to the academy, and you shall be responsible for any resulting liability.

26. User Content Restrictions

Since your user content will be accessible to others, please only post information which you know and understand to be accurate, legal, and appropriate for the audience. You especially agree not to post user content that:

  • is confidential or proprietary of any nature;
  • contains any information or content that is, in Jon Ingham Strategic HR Academy’s reasonable discretion, unlawful, harmful, abusive, racially or ethnically offensive, defamatory, discriminatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, or otherwise objectionable;
  • contains any information or content that is illegal or which you are not authorised to post;
  • may create a risk of harm, loss, physical or mental injury, emotional distress;
  • may create a risk of any other loss or damage to any person or property;
  • may constitute or contribute to a crime or tort;
  • may create a risk of death, disability, disfigurement, or physical or mental illness to you, to any other person, or to any animal;
  • contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships;
  • contains any information or content that you know is not correct and current;
  • could or does violate third-party rights of any kind, including without limitation any Intellectual Property Rights, rights of publicity and privacy.

27. Infrastructure

If you purchase or wish to use or access the academy, you must have compatible and up to date devices, internet access, and the required and up to date software, hardware, technology, and communications equipment. Using incorrect or inadequate infrastructure will likely affect the performance of the academy. It is your responsibility to obtain and properly configure all infrastructure needed to access and use the academy, and, for the avoidance of doubt, pay all costs and fees associated with such maintenance and operation of the Infrastructure.

28. Jon Ingham Strategic HR Property

Except for user content, the academy’s processes, methodologies, materials, designs, formats, documentation, programs, presentations, images, text, graphics, illustrations, logos, trademarks, goodwill, photographs, audio, videos, music are the exclusive property of the Jon Ingham Strategic HR Academy.

29. Ideas

If you submit (with or without a request or inquiry from Jon Ingham Strategic HR Academy) any comments, ideas or feedback about the academy, including improvements, enhancements, features or information, you agree that your disclosure is gratuitous, unsolicited and without restriction, and that by doing so, you do not and will not place Jon Ingham Strategic HR Academy under any obligation. You also agree that we are free to disclose the Ideas on a non-confidential basis to anyone or otherwise use the Ideas without any additional compensation to you. You acknowledge that, by acceptance of your submission, Jon Ingham Strategic HR Academy does not waive any rights to use similar or related ideas previously known to the academy, or developed by its employees, or obtained from sources other than you.

30. Changes

We reserve the right to amend our Terms and Conditions at any time and without notice. If we do this, we will post the amended agreement on the applicable page and indicate the date the agreement was last revised, where applicable. Your continued use of any academy service after any such changes constitutes your acceptance of the new agreement. If you do not agree to any of the terms or any future agreement, you and your organisation, if applicable, must not use or access (or continue to access) the service.

31. Privacy

Privacy is important and we recommend and encourage you to review the separate Privacy Policy to ensure you understand and accept how we gather and use information relating to the academy and you.

32. Security

We have implemented commercially reasonable technical and organisational measures designed to secure personal information provided by members from accidental loss and from unauthorised access, use, alteration or disclosure. However, we cannot guarantee that those measures will never be defeated or that we can stop any person from using or accessing your personal information or user content for improper purposes. Using the academy service is optional and any information you provide, whether or not it is personal, sensitive or user content, is provided at your own risk!

33. indemnity

You agree to defend, indemnify and hold harmless Jon Ingham Strategic HR Academy, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses including legal fees arising from your use of and access to the academy, including any data or work transmitted or received by you;  your violation of any term of the agreement, including without limitation, your breach of any of the representations and warranties above;  your violation of any third-party right, including without limitation any right of privacy, publicity rights or Intellectual Property Rights; your violation of any law, rule or regulation of the UK or any other country; any claim or damages that arise as a result of any of your user content or any that are submitted via your account; or any other party’s access and use of the academy with your unique username, password or other appropriate security code.

34. No Warranty

The Jon Ingham Strategic HR Academy is optional and there is no requirement for the use of the service. If you purchase, use or access https://joningham.academy/ be aware that the service is provided on an ‘as is’ basis and ‘as available’ basis and is available at your own risk. The academy is provided without warranties of any kind. There is no warranty that the content is accurate or correct. There is no warranty that the service will meet your requirements or that the service will be available at a particular time or location, uninterrupted or secure. There is no warranty that any defects or errors will be corrected or that the service is free of viruses or other harmful components. Any content downloaded or otherwise obtained in connection with the academy will be solely at your own risk and you will be solely responsible for any damage to your infrastructure or loss of data or any other liabilities or damages that result from such use.

35. Limitation of Liability

In no event shall Jon Ingham Strategic HR Academy, its affiliates, directors, employees be liable for any direct, indirect, punitive, incidental, special, consequential or exemplary damages. This includes damages for loss of profits, goodwill, use, data or other intangible losses that result from the use of, or inability to use, this service. Under no circumstances will Jon Ingham Strategic HR Academy be responsible for any damage, loss or injury resulting from hacking, tampering or other unauthorised access or use of the service or your account or the information contain within.

Jon Ingham Strategic HR Academy assumes no liability or responsibility for any errors, mistakes or inaccuracies of content, personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our service. Jon Ingham Strategic HR Academy assumes no liability or responsibility for any unauthorised access to or use of our secure servers and/or any and all personal information stored there; any interruption or cessation of transmission to or from the service; any bugs, viruses, Trojan Horses, or the like that my be transmitted to or through our service by any third party; any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available through the service; and/or user content or the defamatory, offensive or illegal conduct of any third party. This limitation of liability section applies whether the alleged liability is based on contract, tort, negligence, strict liability or any other basis even if Jon Ingham Strategic HR Academy has been advised of the possibility of such damage. This limitation of liability policy shall apply to the fullest extent permitted by UK law.

36. Governing Law

You agree that the academy is solely based in the UK and subject to UK law.

37. Notification Procedures

Jon Ingham Strategic HR Academy reserves the right to determine the form and means of providing notifications to our users who may opt in and out of certain means of notification as described in this agreement.

38. Entire Agreement

This Terms and Conditions document, together with any other legal notices and agreements such as the Privacy Policy published by Jon Ingham Strategic HR Academy via the academy or any other agreements entered into between you and Jon Ingham Strategic HR Academy, shall constitute the entire agreement between you and Jon Ingham Strategic HR Academy concerning the academy service.

39. Waiver

No waiver of any term of this agreement shall be considered a further or continuing waiver of such term or any other term, and Jon Ingham Strategic HR Academy’s failure to assert any right or provision under the agreement shall not constitute a waiver of such right or provision.
